Conditions

1. Scope

These Terms and Conditions govern all services provided by Olivia Vogel. This includes, in particular, breathwork sessions, coaching, meditation, and Feng Shui consultations. By booking a service, these terms and conditions are deemed accepted. Any deviations from these Terms and Conditions must be agreed upon in writing beforehand.

 

2. Type of services

The services offered are for personal development, relaxation, and well-being. They do not constitute medical, psychological, or therapeutic treatment and are not a substitute for such treatment. No promises of healing are made.

 

3. Participation is at your own risk

Participation in all services is voluntary. The client bears full responsibility for their own physical and mental health during and after the service.

 

4. Breathwork Sessions (additional conditions)

The customer confirms that they are in good health and undertakes to provide truthful information on relevant health issues prior to participation, in particular:

  • Pregnancy (Breathwork not suitable after the 3rd month)

  • Cardiovascular diseases

  • Mental illness or ongoing trauma therapy

  • Medication use (especially psychotropic drugs / antidepressants)

  • Open or large, unhealed wounds

  • Recent surgeries (especially on the torso or head)

  • Neurological diseases or epilepsy

  • Problems with the heart or nervous system

 

Changes must be communicated immediately.
The provider may refuse participation if there are health concerns.

 

4.2. Risk Disclosure

Breathwork can trigger intense physical and emotional processes (crying, trembling, memories, expressions of grief, laughter, etc.).
Supportive touching is possible, provided consent is not refused.

 

4.3. Consent

By booking, the customer confirms that they have been informed of the risks and are participating expressly at their own risk. Active consent (e.g., checkbox or signed declaration) is a prerequisite for participation.

 

5. Coaching (additional conditions apply)

Coaching is based on preliminary discussions between the parties. It relies on cooperation and mutual trust. I would like to emphasize that coaching is a voluntary, active, and self-directed process, and specific outcomes cannot be guaranteed. The coach supports the client as a process facilitator and guide in making decisions and implementing changes. The actual work of change is carried out by the client. Therefore, the client should be willing and open to engaging with themselves and their situation. Coaching supports personal goals but does not replace professional psychological or medical care. Success depends significantly on the client's commitment. No guaranteed results are promised.

 

5.2. Health status & duty to provide information

If the coachee is under medical and/or psychotherapeutic treatment, they must inform Olivia Vogel before the coaching begins. Furthermore, the coachee must provide confirmation that their doctor and/or psychotherapist approves of the coaching. If the coachee conceals their health condition or any ongoing medical and/or psychotherapeutic treatment, the coaching may be terminated immediately.

 

5.3 Scope of work and conditions

At the beginning of a coaching session, Olivia Vogel clarifies the client's (coachee's) expectations for the coaching. A coaching session, or multiple sessions, cost the agreed-upon price. Payment is made by invoice or online. Invoices for individual coaching sessions must be paid within 20 days. For multiple coaching sessions booked (e.g., 1-month or 3-month coaching), the invoice must be paid before the first session.

 

6. Feng Shui consultations (additional conditions apply)

Feng Shui is based on energetic and subjective interpretations of spatial qualities.
The recommendations do not replace a structural engineering or legal review (statics, fire protection, building regulations, etc.).
The responsibility for planning, implementation and any construction risks lies exclusively with the client.

 

7. Ability to act

The client is of legal age and capable of making sound judgments, or presents a declaration of consent from their legal representative explicitly agreeing to coaching or other services provided by Olivia Vogel.

 

8. Prices & Payment

All prices are in CHF. Payment terms are as stated in the booking system or on the invoice.

 

9. Cancellation policy / Cancellation fees

A coaching session or other service (breathwork sessions, meditations, Feng Shui consultations, etc.) can be cancelled free of charge up to 24 hours in writing before the appointment. For Monday appointments, the deadline is Friday at 12:00 noon. After this time, the full fee is due. Short-notice cancellations or no-shows will be charged in full. Special offers are subject to the cancellation policy agreed upon in writing.

 

10. Confidentiality

Olivia Vogel undertakes to maintain strict confidentiality towards third parties regarding all business and private matters of the client that become known to her in the course of her work, even after the termination of the contract.

Olivia Vogel is bound by confidentiality. However, she reserves the right to lift her confidentiality obligation should a risk of self-harm or harm to others become apparent. In this case, she will contact a professional.

 

11. Data Protection

Personal data is treated confidentially in accordance with the Swiss Federal Act on Data Protection (FADP). Health data and consent forms are kept for at least 10 years for evidentiary purposes.

 

12. Copyright, Terms of Use

The copyright for all documents, concepts, designs and other materials created by Olivia Vogel in connection with the service remains with Olivia Vogel.

All material in any form created by Olivia Vogel in connection with a service or provided to the client in connection with the provision of services may only be reproduced, published, or made publicly available with the express written consent of Olivia Vogel. In particular, it may not be used for similar services, revised, rewritten, or otherwise altered or adapted.

 

13. Liability

Olivia Vogel provides her services with professional diligence.
A specific outcome is not guaranteed.

To the extent permitted by law:

  • Liability for slight and moderate negligence is excluded.

  • Claims for damages resulting from concealed or incorrect health information will be rejected.

  • The provider is not liable for consequential damages (physical, psychological, material).

Liability for gross negligence or intent remains reserved by law.

 

This disclaimer applies in full to breathwork sessions. For coaching and Feng Shui consultations, it applies within the limits of the law.

 

All participants are insured either personally or through their employer. The sending or electronic transmission of any data is at the client's own risk.

 

14. Place of jurisdiction

Swiss law applies exclusively. The place of jurisdiction is Lucerne.

 

15. Final Provisions

Olivia Vogel reserves the right to amend these Terms and Conditions at any time. Should these Terms and Conditions contain any contradictions or omissions, the appropriate provision shall be determined based on the purpose, meaning, and spirit of the provisions, the principle of good faith, and the mutual interests of the parties. Should any provision be or become invalid, this shall not affect the validity of the remaining provisions.
